Original Held v. Montana Plaintiff Discusses New Federal Lawsuit

Press Release

Young Plaintiffs Launch New Climate Lawsuit Against Trump Administration

Helena, MT – In a landmark move for climate advocacy, ten young plaintiffs from the Held climate change lawsuit have initiated a new lawsuit against the Trump administration, challenging three executive orders that seek to ramp up fossil fuel production in the United States. The lawsuit, filed in federal court in Butte, claims that these policies undermine the young plaintiffs’ rights to a "clean and healthful environment," as many experience direct climate-related impacts in their daily lives.

Eva Lighthiser, a 19-year-old from Livingston and lead plaintiff in the case, emphasized the urgency of the climate crisis, stating, "What worries me is the fact that… we need to be taking action against climate change, and that is not happening." The other plaintiffs, aged 7 to 25, share similar concerns about the worsening environmental conditions they have faced, such as increased heat, wildfires, and flooding.

The lawsuit targets specific executive actions aimed at deregulating fossil fuels, declaring an "energy emergency," and promoting coal production. The plaintiffs argue that these measures exacerbate greenhouse gas emissions, with detrimental effects on health and safety. Legal representatives from Our Children’s Trust, who are also involved in the original Held lawsuit, argue that such executive actions violate the youths’ fundamental rights to life and liberty.

Montana, where many of the plaintiffs reside, faces significant consequences from these policies, particularly in relation to coal production, wildfires, and flooding. Lighthiser expressed her gratitude for the opportunity to represent the case, highlighting the importance of using their voices to seek change.

The case signifies a growing movement among youth advocates who are proactively challenging governmental policies that they believe jeopardize their future and the planet.
