Federal Appeals Court Halts Rulings on Trump Tariffs, Permitting Their Continuation


On Thursday, a federal appeals court issued a temporary stay on lower court rulings that had halted several of President Donald Trump’s tariffs on international trade. The U.S. Court of Appeals for the Federal Circuit stated that the injunctions from the Court of International Trade would remain paused until at least June 9. This pause allows both parties to submit arguments regarding the extended stay while the appeal progresses. Attorney Jeffrey Schwab, representing the plaintiffs, viewed this ruling as a procedural move, expressing confidence that the Federal Circuit would ultimately deny the government’s request for a longer stay.

Trump’s administration celebrated the ruling, with Kevin Hassett from the National Economic Council calling it a significant victory. White House Senior Counsel for Trade Peter Navarro asserted that the administration would find ways to implement the tariffs, regardless of the outcome of the legal challenges, promising a forthcoming response from U.S. Trade Representative Jamieson Greer.

The earlier judgment from the Court of International Trade, made by a panel comprising judges appointed by presidents Reagan, Obama, and Trump, concluded that the decades-old International Emergency Economic Powers Act does not grant the President unlimited authority over tariffs. In a parallel ruling, U.S. District Judge Rudolph Contreras in D.C. deemed many of Trump’s tariffs unlawful, affecting only two educational toy manufacturers. He questioned whether the International Emergency Economic Powers Act permits the President unilateral tariff adjustments, highlighting that previous presidents have not done so.

The administration is currently appealing both rulings while contending that halting the tariffs would harm U.S. foreign policy and national security. Contreras countered that the administration could not use the consequences of unlawful actions as a defense against judicial review.
