Montana Legislature Moves Forward with Judicial Reform Initiatives

Helena, MT – The recent Montana legislative session prominently featured efforts to reform the state’s judiciary, underscoring Governor Greg Gianforte’s commitment to this priority. Lawmakers introduced a staggering 150 bills focusing on judicial matters, with significant attention directed toward 27 proposals advanced by the Senate Select Committee on Judicial Oversight and Reform.

Among the seven committee bills that successfully passed the legislature, House Bill 39 has drawn particular interest by allowing political parties to contribute to judicial candidates. Other notable legislation includes Senate Bills 30, 38, 39, 40, 41, and 45, all of which were amended at the governor’s request.

In a press conference, Governor Gianforte emphasized the necessity of a judiciary that adheres strictly to the rule of law rather than advancing political agendas. He remarked, "We want Montanans to vote based on the affiliation of these judges. We have nonpartisan races in Montana in name only," highlighting his administration’s aim to make judicial candidacy races more partisan.

Despite these advancements, a key legislative goal to mandate partisan elections for judges—pursued through Senate Bill 42—failed to gain traction in the House. Additionally, House bills 751 and 838, which shared this objective, did not meet the legislative deadline.

As several passed bills await the governor’s signature, the evolution of these legislative measures will be closely monitored for their potential impact on Montana’s judicial framework. The state’s focus on judicial reform marks a pivotal shift that promises to influence the legal landscape in the coming years.
