Montana is experiencing a surge in commercial media productions, including the hit series "Yellowstone," largely attributed to the Media Act’s 2019 enactment. As we head into the 2025 Montana Legislative Session, lawmakers are advocating for the continuation of this momentum through Senate Bill 326. Sponsored by Senator Greg Hertz (R-Polson), the bill proposes to maintain the existing $12 million annual allotment for MEDIA Act tax credits while extending the program through 2045.

Key changes in the bill aim to prioritize benefits for Montana-based production companies and residents. Should the bill be enacted, qualified media production companies could receive a 30% tax credit on costs associated with each crew member who is either a Montana or tribal resident or a student enrolled at a Montana university. Additionally, companies would be eligible for a 40% tax credit for renting facilities within the state.

SB 326 also includes provisions to fund a comprehensive report on media production activities in Montana, allowing for an assessment of whether productions are leaving the state or staying. "The interesting part about this bill," noted Senator Hertz, "is that when we reconvene in 2027, we will have a clearer picture regarding the impact of these media credits on Montana."

The Senate recently passed SB 326 in a decisive vote of 31 to 19, and the bill is now headed to the governor’s desk for final approval. With these initiatives, Montana aims to solidify its status as a prime location for media production, ensuring economic benefits for local communities.
