Bill to Phase Out Styrofoam Arrives on Gianforte’s Desk

Press Release

Helena, Mont. — A significant step towards environmental sustainability is underway as House Bill 477, aimed at phasing out the use of Styrofoam in Montana restaurants, has reached Governor Greg Gianforte’s desk. Sponsored by State Rep. Marilyn Marler (D-Missoula), the bill prohibits the use of polystyrene in food-related businesses starting in 2028. Initially, the ban covers in-house food and drink served in Styrofoam containers, with further restrictions on packaging for prepared food, such as bakery items, set to take effect in 2030.

Rep. Marler emphasized that "these plastics are toxic, cannot be recycled, and do not decompose in the environment." While the bill exempts raw meat, fish, and eggs, businesses will have the option to apply for an exemption by paying a fee. Governor Gianforte’s spokesperson confirmed the bill was received on April 24 and stated that the governor will carefully evaluate it. Should no action be taken within ten days, the bill will automatically become law, marking a pivotal shift in Montana’s environmental policy and encouraging sustainable practices in the food industry.
