Helena Real Estate Agent Sentenced for Failure to Provide Lead-Based Paint Disclosures to Veterans

Melanie Ann Carlin, a Helena real estate agent, has been fined $150,000 and sentenced to three years of felony probation for failing to disclose lead-based paint hazards to veterans at Fort Harrison. Carlin, the owner of 406 Properties, Inc., pleaded guilty to one felony count of knowing endangerment. The investigation revealed that Carlin did not provide lead-based paint disclosures from September 2019 to September 2021, endangering veterans and their families at Freedom’s Path Fort Harrison.

Mold Wranglers, Inc., another company involved in the case, was sentenced to two years of probation, fined $50,000, and ordered to pay $348,000 in restitution to the U.S. Department of Veterans Affairs for filing false reports about lead abatement. The investigation also found that Carlin falsely claimed the properties were built after 1978 when she received a request for lead remediation information in May 2019. In September 2021, an 18-month-old child in one of the units was found with lead poisoning after ingesting paint chips.

The U.S. Attorney’s Office in the District of Montana, led by U.S. Attorney Kurt Alme, has taken action to hold Carlin accountable for her actions that put veterans at risk of significant lead exposure.
