They have also requested the dismissal of the murder charge and leaving the scene allegation based on a mistake made by the judge after the mistrial was declared. The defense claims that the jury would have acquitted Read of the charges had they reached a verdict, but the judge did not conduct a proper fact-finding process.

The retrial is scheduled to begin on April 1, with the defense continuing to push for the dismissal of charges based on claims of misconduct and procedural errors.
