Judge prohibits moving 3 transgender inmates to male prison

A federal judge in Washington, D.C., has temporarily blocked prison officials from transferring three transgender women to men’s facilities and cutting off their access to hormone therapy, as mandated by an executive order signed by President Donald Trump. The judge granted a temporary restraining order in response to a lawsuit filed on behalf of the women, arguing that Trump’s order discriminates against transgender individuals and violates their constitutional rights. This ruling comes after a similar decision by a federal judge in Boston in a separate case involving a transgender woman in a women’s prison.

Trump’s executive order requires the Bureau of Prisons to ensure that men are not detained in women’s prisons and to revise medical care policies related to transgender inmates. The plaintiffs’ attorneys argued that moving the women to men’s prisons would endanger their safety and mental well-being, as well as disrupting their access to hormone therapy for gender dysphoria. The judge determined that the public interest does not require the immediate relocation of the plaintiffs to male facilities and sided with the women in terms of the balance of equities and public interest.

The plaintiffs’ legal team, represented by National Center for Lesbian Rights and GLAD Law, argued that Trump’s order violates their clients’ constitutional rights and poses significant risks to their safety in male prisons. The Department of Justice countered that the women have not been denied medical care since the order was signed, and decisions about their transfers have not yet been made. The plaintiffs are seeking to maintain the status quo and stay in women’s facilities to ensure their safety and well-being.
