Montana House Votes to Implement Transgender Bathroom Ban for All Lawmakers


The Montana House, controlled by Republicans, has voted to endorse a ban on transgender people using bathrooms that do not align with their sex assigned at birth, despite objections from two fellow lawmakers who are transgender and nonbinary. The legislators argued that such a ban would be discriminatory and unnecessary, as there is no evidence to suggest that trans people pose a threat to others. The bill, sponsored by Rep. Kerri Seekins-Crowe, is intended to preserve safe spaces for women, according to its supporters.

The measure faces a final House vote before heading to the GOP-controlled state Senate. If passed, trans people would be prohibited from using restrooms, changing rooms, and sleeping areas that align with their gender identity in public buildings, schools, prisons, jails, and programs for domestic violence victims. Individuals could sue facilities for not preventing trans people from using certain facilities but would only be able to recover nominal damages, generally $1.

Rep. Zooey Zephyr, who was previously silenced and sanctioned by Republican colleagues, warned that the bill could lead to conflicts and potentially dangerous situations in public facilities. Despite concerns raised by some Republicans, the bill passed in a party-line vote. Critics argue that the bill goes against Montana values of love thy neighbor and minding one’s business. The move comes amid a broader trend of states passing laws that restrict the rights of transgender individuals, particularly in the areas of bathroom use and medical care.
